Federal FLSA rule: time and a half for hours over 40 in the workweek. Daily overtime and double time in some states are not applied.

How it's calculated

The Fair Labor Standards Act requires covered, non-exempt employees to be paid at least one and one-half times their regular rate for hours worked over 40 in a workweek. The calculator splits your hours at 40 and prices the rest at the overtime rate.

Overtime rate
= hourly rate × 1.5
Regular pay
= min(hours, 40) × hourly rate
Overtime pay
= max(0, hours − 40) × overtime rate
Total
= regular pay + overtime pay

Worked example

$20.00 an hour, 45 hours in the week:

  1. Regular pay: 40 × $20.00 = $800.00
  2. Overtime: 5 × $30.00 = $150.00
  3. Total $950.00 before taxes

Frequently asked questions

How is overtime calculated?

Under the Fair Labor Standards Act, non-exempt employees get at least 1.5 times their regular rate for hours over 40 in a workweek. At $20.00 an hour, 45 hours pay $800.00 for 40 hours plus 5 × $30.00 = $150.00 overtime, $950.00 in total.

What is time and a half?

The overtime rate: your regular hourly rate multiplied by 1.5. $20.00 an hour becomes $30.00 for each overtime hour. Some states and employers pay double time in certain cases; federal law requires only time and a half.

Is overtime paid for working more than 8 hours in a day?

Not under federal law, which counts hours over 40 in a workweek. A few states, such as California, require daily overtime; check your state's rules. Weekend or holiday work earns overtime only if it pushes the week over 40 hours.

Who is exempt from overtime?

Salaried executive, administrative and professional employees who meet the FLSA duties and salary tests, outside sales staff and certain other categories. Most hourly workers are non-exempt and must receive overtime.

Does the regular rate include bonuses?

Non-discretionary bonuses, commissions and shift differentials are part of the regular rate used for overtime; this calculator uses the base hourly rate you enter. Add those amounts to the rate if they apply.
